Legal overview · Spain
Is weed legal in Madrid?
A short, plain-language overview of how Spanish law treats cannabis and why private cannabis clubs exist.
The short answer
In Spain, private consumption of cannabis by adults is not penalised, but buying, selling or carrying it in public places is. Consumption or possession in public can result in an administrative fine, and selling cannabis is a criminal offence. Cannabis associations operate in a legal grey area, and courts and authorities have taken different positions over time.
What this means in Madrid
Private consumption
Adults consuming in a private space is not sanctioned.
Public places
Consuming or carrying cannabis on the street, in parks or in cars can be fined.
Sales
Selling to the public is illegal. Cannabis clubs are closed, non-profit associations for members only.
Tourists
Visitors are subject to the same rules as residents. Ignorance is not a defence.
Why a private club?
A cannabis club works only inside its membership: adults, approved, informed and bound by written rules. That is why Alquimia asks you to apply first, show ID and accept the club rules. If you are visiting, see our weed in Madrid guide.
